These Terms of Service ("Terms") govern your access to and use of the InGen Intelligence platform, including the Ginny AI marketing assistant, InGen OS dashboard, InGen Studio, and all related services (collectively, the "Platform"), operated by The InGen Corporation ("InGen," "we," "us," or "our").
By creating an account, completing the registration process, or using the Platform, you ("Client," "you," or "your") agree to be bound by these Terms. If you do not agree, do not use the Platform.
InGen Intelligence provides an AI-powered marketing operating system. The Platform includes:
You must be at least 18 years of age and have the legal authority to enter into a binding agreement to use the Platform. If you are registering on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
During registration, you will provide information about your business, including your company name, industry, target markets, marketing goals, and other details necessary for Ginny to deliver effective marketing services. You agree that all information provided is accurate and current.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify InGen immediately of any unauthorized use of your account.
The Platform operates on a Bring Your Own Key (BYOK) model. You are required to provide your own API key from a supported AI provider (e.g., Anthropic, OpenAI, Google, xAI) to power Ginny's AI capabilities.
All API usage costs are billed directly by your chosen AI provider to you. InGen does not charge for, mark up, or intermediate API usage fees. Your API spend is entirely between you and your provider. Typical usage ranges from $5 to $20 per month depending on activity level and model selection.
Your API key is stored securely on InGen's infrastructure and is used solely to authenticate requests to your chosen AI provider on your behalf. Your key is never shared with other clients, third parties, or used for any purpose other than powering your Ginny instance.
Access to the Platform requires a paid subscription. Current pricing is published at learn.ingenpublishing.com/pricing. InGen reserves the right to modify pricing with 30 days' advance notice.
Subscription fees are billed monthly via Stripe. By subscribing, you authorize InGen to charge your payment method on a recurring basis until you cancel.
You may cancel your subscription at any time. Upon cancellation, you retain access through the end of your current billing period. No refunds are issued for partial billing periods.
InGen Studio is an optional add-on service for AI-powered video production and media creation, available for an additional monthly fee. Studio access is activated upon payment and deactivated upon cancellation of the add-on. Studio capabilities are only available when the add-on is active.
You retain full ownership of all content you provide to the Platform, including but not limited to business information, brand assets, uploaded files, and marketing materials. You also retain ownership of all content generated by Ginny on your behalf, including blog posts, social media content, email campaigns, and creative assets.
You grant InGen a limited, non-exclusive, non-transferable license to process your content solely for the purpose of providing the Platform services. This license terminates when your subscription ends and your data is deleted.
The Platform, including its software, design, workflows, and AI configurations, is the intellectual property of The InGen Corporation. Your subscription grants you a right to use the Platform, not ownership of any underlying technology.
All conversations between you and Ginny are logged and may be reviewed by InGen for the following purposes:
Conversation data is never sold to, shared with, or made accessible to other clients or third parties. Your conversations are isolated to your account. See our Privacy Policy for full details.
Each client account operates in complete isolation. Your data, conversations, content, analytics, and configurations are scoped exclusively to your account. No other client can access your data, and your data is never used to train, influence, or inform services provided to other clients.
You agree not to use the Platform to:
InGen reserves the right to suspend or terminate accounts that violate these terms.
The Platform is provided "as is" and "as available." Ginny is an AI marketing assistant that provides guidance and generates content based on the information you provide. InGen does not guarantee specific marketing outcomes, revenue increases, lead generation results, or business performance improvements. Marketing results depend on numerous factors beyond the Platform's control.
To the maximum extent permitted by law, InGen's total liability for any claims arising from your use of the Platform shall not exceed the total subscription fees you have paid to InGen in the twelve (12) months preceding the claim. InGen shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
You may terminate your account at any time by canceling your subscription and contacting kyle@theingencorporation.com.
InGen may terminate or suspend your account for violation of these Terms, non-payment, or at our discretion with 30 days' notice.
Upon termination, you may request an export of your data within 30 days. After 30 days, your data may be permanently deleted. Your API key is immediately removed from our systems upon termination.
InGen may update these Terms from time to time. Material changes will be communicated via email to the address associated with your account at least 14 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. A changelog of all modifications is maintained at learn.ingenpublishing.com/legal-changelog.
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Davidson County, Tennessee.
